Bob Barr, David Keene and Grover Norquist have called for civilian trials of terror suspects, and urged that the “scaremongering about these issues has to stop.”
There are problems with civilian trials, of course. Many detainees were freed by Bush’s extralegal system who would have likely been convicted and be sitting in prison right now. And should New York courts really try some of these cases – that don’t involve “terrorism” at all, but simply fighting back against military forces in the Afghanistan war?

you don’t think “scaremongering about these issues” is going to end, do you? fear and terror are the main products of our government. they have nutrition labels all made up for it.
and the people are getting fat they like it so.

Serious question. Is it true that trying them in criminal courts would allow them to go free on account of things like not having been read their Miranda rights when they were captured?

Eric, these particular suspects were read their Miranda rights and are going to be tried according to post-Miranda evidence. The administration wouldn’t try anyone who isn’t guaranteed to be convicted. That’s why most of the Gitmo detainees, the more innocent ones against whom the government has no case, will continue to rot indefinitely in extraconstitutional U.S. dungeons.
